General Terms and Conditions

Article 2 – Applicability

These general terms and conditions apply to all offers, orders, and agreements between HelmetCoverStore (Xtenate) and the customer, whether a consumer (B2C) or a business (B2B).

By placing an order, the customer accepts these terms and conditions. Deviations are only valid if agreed upon in writing.

These terms and conditions supersede any purchasing conditions or other terms of the customer, unless HelmetCoverStore has explicitly agreed otherwise in writing.

 

Article 3 – Offers and Prices

All offers on the website are non-binding and subject to availability. HelmetCoverStore reserves the right to change prices at any time.

Prices are displayed in euros (EUR) and include VAT (btw), unless stated otherwise. Shipping costs are not included in the product price and are shown separately during checkout.

If a price error occurs on the website, HelmetCoverStore is not obligated to deliver the product at the incorrect price and may cancel the order with a full refund.

 

Article 4 – Orders and Agreement

An agreement is concluded when the customer completes the checkout process and receives an order confirmation by email.

HelmetCoverStore reserves the right to refuse orders in exceptional cases, for example in case of suspected fraud or incorrect customer information.

 

Article 5 – Order Cancellation

Customers may cancel their order within 24 hours of placing it by emailing info@helmetcoverstore.com. After this window, the order may already have been processed and shipped.

Cancellations after 24 hours are subject to our standard return policy (see Article 8).

 

Article 6 – Shipping and Delivery

Orders are shipped within 1–2 business days of payment confirmation.

Shipping costs are €4.25 per order. Shipping is free for orders of €65 or more.

Estimated delivery times are indicative and may vary by destination country. Typical delivery within Europe is 3–7 business days.

HelmetCoverStore is not liable for delays caused by carriers, customs, or circumstances beyond its control.

Risk of loss or damage to products passes to the customer upon delivery.

 

Article 7 – Right of Withdrawal (Consumers Only)

In accordance with EU consumer law (Directive 2011/83/EU), consumers have the right to withdraw from their purchase within 14 days of receiving their order, without giving any reason.

To exercise this right, the customer must notify HelmetCoverStore within the 14-day period by emailing info@helmetcoverstore.com. The customer then has 14 additional days to return the product.

The right of withdrawal does not apply to:

       Products that have been personalised or custom-made

       Products that have been used or are no longer in original condition

       Products with missing or damaged original packaging or tags

Business customers (B2B) are not entitled to a statutory right of withdrawal unless agreed otherwise in writing.

 

Article 8 – Returns and Exchanges

HelmetCoverStore offers free returns within 14 days of receipt for consumers.

To initiate a return:

       Email info@helmetcoverstore.com with your order number and reason for return

       Ensure the product is unused and in its original packaging with tags attached

       Ship the product back and provide a tracking number

Refunds are processed within 5 business days of receiving the returned item in good condition, to the original payment method.

Exchanges are also accepted within 14 days. Contact us by email to arrange an exchange.

 

Article 9 – Payment

Payment is due at the time of ordering. HelmetCoverStore accepts the payment methods displayed at checkout.

If a payment is not received or is reversed, HelmetCoverStore may cancel the order or pursue recovery of the outstanding amount.

 

Article 10 – Warranty and Complaints

HelmetCoverStore guarantees that its products meet the description on the website and are free from manufacturing defects at the time of delivery.

Consumer customers are entitled to a legal warranty of 2 years in accordance with Dutch and EU law.

If a product is defective or does not match the description, the customer must notify HelmetCoverStore within 2 months of discovering the issue by emailing info@helmetcoverstore.com.

The warranty does not cover:

       Normal wear and tear

       Damage caused by improper use or accidents

       Damage caused by unauthorised modifications

 

Article 11 – Liability

HelmetCoverStore is not liable for indirect damage, consequential loss, or loss of profits arising from the use of its products, unless caused by wilful misconduct or gross negligence.

HelmetCoverStore's total liability is in all cases limited to the amount paid by the customer for the relevant order.

Product images, colours and descriptions on the website are for illustration purposes only. Minor variations may occur.

 

Article 12 – Privacy

HelmetCoverStore processes personal data in accordance with its Privacy Policy, available at helmetcoverstore.com/policies/privacy-policy, and in compliance with the General Data Protection Regulation (GDPR).

 

Article 13 – Force Majeure

HelmetCoverStore is not liable for failure to fulfil its obligations if this is caused by circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, government measures, or carrier delays.

In the event of force majeure lasting more than 30 days, either party may terminate the agreement in writing without compensation.

 

Article 14 – Governing Law and Disputes

These terms and conditions are governed by Dutch law.

Disputes will be submitted to the competent court in the district of Zeeland-West-Brabant, The Netherlands, unless mandatory law provides otherwise.

Article 15 – Amendments

HelmetCoverStore reserves the right to amend these terms and conditions at any time. The most current version will always be available on the website. For existing orders, the terms applicable at the time of the order apply.
